Tekashi 6ix9ine Arrested on Federal Crime Charges, Faces Potential Life Sentence

The controversial rapper and his former associates are accused of operating and managing a gang

Daniel Hernandez, the Brooklyn rapper known as Tekashi 6ix9ine, was arrested in New York City on federal crime charges last night (November 18), TMZ reports and Pitchfork has confirmed with the U.S. Attorney’s office. 6ix9ine’s ex-manager Shottie, real name Kifano Jordan, and their associates Faheem Walter (aka Crippy), Jensel Butler (aka Ish), Jamel Jones (aka Mel Murda), and Fuguan Lovick (aka Fu Banga) were also arrested. They all face racketeering and firearms charges. Hernandez is currently in federal custody. 6ix9ine said last week that he had fired Shottie and the rest of his management team.

According to the eight-count indictment, viewed by Pitchfork, Hernandez and the other defendants “participated in the operation and management of” the Nine Trey Gangsta Bloods. The indictment accuses gang members of murder, robbery, assault, the sale of drugs, and more. Two of the charges Hernandez faces have a maximum penalty of life in prison.

The Blast reports that Hernandez has been denied bail due to a determination by the presiding judge that he poses a danger to the community and “would still be able to direct acts of violence by telephone” were he allowed out on house arrest. Documents viewed by Pitchfork confirm that the U.S. Attorney for the Southern District of New York recommended that Hernandez be held “because there are no set of bail conditions that will reasonably assure his appearance as required or the safety of the community.” Pitchfork has emailed a representative for 6ix9ine for comment.

Hernandez, Jordan, and two other associates are accused of robbing unknown rivals of the gang at gunpoint on April 3. The indictment also references a July 16 shooting incident in Brooklyn. Hernandez and others are accused of agreeing “to shoot an individual who had shown disrespect to members of Nine Trey, and as a result of this agreement an innocent bystander was shot.”

The investigation that led to 6ix9ine’s arrest was conducted by the U.S. Attorney’s office with the NYPD, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and Homeland Security Investigations. Pitchfork can confirm via records that Hernandez is currently being held at the Metropolitan Detention Center in Brooklyn.

“As alleged in the indictment, this gang, which included platinum-selling rap artist Tekashi 6ix9ine, wreaked havoc on New York City, engaging in brazen acts of violence,” U.S. Attorney Geoffrey S. Berman said in a statement. “Showing reckless indifference to others’ safety, members of the gang were allegedly involved in robberies and shootings, including a shooting inside the crowded Barclay’s Center, and a shooting in which an innocent bystander was hit.”

Hernandez’s lawyer Lance Lazzaro told XXL that he considers the indictment “an over-charge by the U.S. Attorney’s Office.” He added, “When the facts come out I am confident that the charges will be dismissed as it relates to Daniel Hernandez.”

Earlier this month, police apprehended Jordan in connection with an incident in which Walter, in his capacity as 6ix9ine’s bodyguard, was shot and later charged with gang assault.

Hernandez is currently on probation, stemming from an October 2015 guilty plea to the use of a child in a sexual performance. Sentencing in the case dragged on for years until, last month, a New York judge gave Hernandez four years of probation and required him to complete community service, refrain from gang affiliation, and avoid future arrests.

Daniel Hernandez also has a pending legal case in Texas. This past January, Hernandez allegedly choked a 16-year-old at the Galleria Mall in Houston, Texas. Hernandez and his security demanded that the teenager erase video footage of the incident from his phone, according to a police report. In May, he was charged with misdemeanor assault, and he was arrested on the Texas warrant in July.
